After your claim is approved, you will likely get a call from your insurance company about sending an insurance adjuster out to assess the damage or asking you to send your car to a pre-approved shop to get it fixed. An insurance company may have a direct repair program and have an agreement with a shop for the damage repair. The damage claim estimate may be done by the shop itself and not by the claims adjuster. The check can be sent right to the shop to start the repair works. If you need a rental car for this period, the shop may also make proper arrangements.

What to Do If Your Auto Insurance Company Denies Your Claims

You pay your premiums on time and comply with all the terms of policy, and yet your auto insurance company refuses to acknowledge your claims. Before hiring a lawyer and embarking in an expensive litigation process, you may want to follow these tips and override a no reimbursement decision.

* Inform your car insurance company that you are not satisfied with the way claims are handled. Document all the phone calls made with the company. Take note of the name and position of persons you spoke with. Check if each representative was saying the same reasons for claims denial. If agents and customer representatives cannot help settle claims, go directly to the claims department or escalate your case to the customer complaint office. * Check your auto insurance policy for mediation and arbitration clauses. Insurers often provide for arbitration and appraisal services to settle claims disputes. An arbitrator is the party authorized by you and your insurer to settle disputes. Choose from arbitrators suggested in your insurance policy or hire an independent arbitrator instead. A mediator, on the other hand, only helps both parties reach an agreement. Unlike arbitrators, mediators have no authority to settle a dispute.

* Seek help from the state insurance department. Explain to the agency the cause of the disagreement and ask for available options to settle your complaint.

Refusal to pay auto insurance claims does not necessarily mean that an auto insurance company is doing business in bad faith. Insurance fraud is very common, and there are times when a claim is hard to justify due to lack of material evidence. An insurance policy may also contain disclaimers that are subtly written to forestall claims. Hiring a lawyer will be your last resort. Unless you have a strong case to pursue, consider suing your auto insurance company. If claims are valid, insurers will definitely reverse their position and seek settlement. Before initiating a lawsuit, weigh the risks and benefits involved. Ask your lawyer if a court has ruled a case similar to yours. Moreover, think from the point of view of your insurer to anticipate for legal defenses they may raise against your claims.
